Arbitration Location and Proceedings. Unless you and UnitedBestProviders agree otherwise, arbitration proceedings shall take place in Clark County, Nevada. If your claim does not exceed $25,000, the arbitration may be conducted entirely on the basis of documents submitted to the arbitrator, through a telephonic or video hearing, or by an in-person hearing as established by the AAA Rules. The arbitrator shall have the authority to award any relief that would be available in a court of law.

Class Action Waiver. YOU AND UNITEDBESTPROVIDERS AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, REPRESENTATIVE, OR MULTI-PARTY ACTION OR PROCEEDING. THE ARBITRATOR SHALL NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND SHALL NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS, REPRESENTATIVE, OR MULTI-PARTY PROCEEDING. If this class action waiver is found to be unenforceable, then the entirety of this arbitration agreement shall be null and void, and all Disputes shall be resolved in court.

Jury Trial Waiver. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND UNITEDBESTPROVIDERS EACH WAIVE THE RIGHT TO A JURY TRIAL IN ANY COURT PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE.

Time Limitation on Claims. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to your use of the Website or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred. This one-year limitation period begins on the date the claim or cause of action first accrues.

Severability.
